Contracts with Designers in Green Construction

  1. Designers:
    1. Allocate liability between builder and designer as clearly as possible
    2. Reserve right to trump designer if not feasible or in violation of local laws or building codes.
    3. Consider whether designer will remain involved throughout the project.
    4. Request indemnity clause. They will pay the builder back if they are held liable.
